Following the Supreme Court’s 2015 decision in Obergefell v. Hodges in which the Court first acknowledged a fundamental right under the Fourteenth Amendment to marriage equality, several states and municipalities have enacted laws and ordinances protecting the free exercise of religious beliefs that oppose same-sex marriage. The First Amendment Defense Act (FADA), as well as contemplated executive orders, have since followed and threaten to protect anti-LGBTQ discrimination if predicted upon particular religious beliefs or moral convictions.
